Justice?

Can there ever really be justice? I never thought I would question this

Really never cared or had a reason to give it too much thought before

I arrived in Las Vegas in 2000 due to the passing of my father

It was a sad time for me reconnecting with my little sister

Who I hadn’t seen in many years. This is how I met Stanley L. Gibson

My brother in law and him were friends and he had come over one day

And that basically was the day we started our life together

For the next 12 years it was just Stan-N-Rondha

Two orphans against the world, but we had love

We shared a love that no-one could ever understand

But it was our love and then in one quick instant it was gone

By the hands of the people that say they are here to serve and protect

What they don’t tell you is they only serve and protect each other

They say if you are robbed you should call the police but

I ask you who do I call when Metro was the one who robbed me

This power LVMPD has to kill without consequence needs to end

Too much blood has been spilt due to their actions

Too much innocent blood has been shed

Stand beside me and let our voices be heard

NEVER FORGET! NEVER FORGET!

by

The first “Police Fatality Public Fact-Finding Review,” regarding the murder of Stanley Gibson by Metro Officer Jesus Arevalo, is scheduled to take place on Thursday February 28th beginning at 9:00 am and will be located at the Clark County Government Center, where the Clark County Board of Commissioners hold their regular meetings.

We’ll be meeting up at 8:00am in order to organize together and go over the specifics of what we will be doing to bring attention to Stanley’s murder. It’s incredibly important for anyone that cares about justice and supports accountability for police that commit crimes against people within the Las Vegas community to be there and make their voice heard for past victims of police violence and to prevent future innocent victims.

In spite of the long-winded name change, the new process that was created by LVMPD’s Sheriff Gillespie and Chris Collins of the Las Vegas Police Protective Association (Police Union) is designed to do anything but allow the public to find facts. The reality is that it is much worse than the original, much maligned, Coroner’s Inquest system that it will be replacing.

Unlike the Coroner’s Inquest, the Police Fatality Review will involve no opportunity for testimony from witnesses and only voluntary testimony by the police involved in the shootings, which the LVPPA has already gone on record as saying that pretty much has no chance of happening. What it amounts to is a choreographed staging of the police department’s version of events with zero representation from a genuine neutral party, the victim’s family, or independent witnesses.

Clark County District Attorney Steve Wolfson actually referred to it as a “performance,” while endorsing it, during the Commissioner’s meeting in which it was initially proposed. That’s just how much of a blatant and callous cover up the Police Fatality Review is.

The first case to go before this Police Fatality Review involves the murder of Stanley Gibson, an unarmed man who was shot seven times by Jesus Arevalo in spite of having committed no actual crime and having had his vehicle blocked in by several police cars so that it was unable to move.

Stanley, a disabled veteran, who was lost and suffering a panic attack as a result of PTSD and other ailments he suffered during his time in the Persian Gulf, represented no direct or imminent probability of harming anyone at the time.

There was no reason for any of the dozens of heavily armed police to feel in any way threatened by him. And the fact that of all those cops there, only Jesus Arevalo felt the need to fire the shots that killed Stanley Gibson only supports that conclusion.

Caution Police State ahead

Instead of holding someone that at best was grossly negligent that night accountable for his actions, D.A. Wolfson, Sheriff Gillespie, LVPPA’s Chris Collins, the Clark County Board of Commissioners, and every other member of the LV Metro Police Department are closing ranks around him in a misguided attempt to cover up yet another officer involved shooting under what could only mildly be called questionable circumstances.

Anyone living in Las Vegas should be well aware that there is a longstanding problem with brutality and outright murder by members of Las Vegas area police departments, especially those of the LVMPD. In several cases, especially those involving Stanley Gibson, Erik Scott, Trevon Cole, Henry Rowe, and Rafael Olivas, the circumstances behind the shooting have been incredibly questionable, if not completely inexcusable.

The obvious reason for the mounting body count by local police is the fact that no Las Vegas area police officer has EVER been held accountable for shooting someone, no matter how questionable that shooting has been.

Replacing what was already a terribly flawed system with one that not only retains those flaws, but incorporates even less transparency and can only be seen as a conscious effort to ensure the police never have to fear being held accountable for deaths they cause not only doesn’t address this problem, but in reality actually makes it harder for the police to do the things they are supposed to do by creating a lack of trust and discouraging any support for police from the people living within the community that they work.

It’s a self-perpetuating downward spiral that only exacerbates an already toxic and often violent relationship. The time to put an end to this has already passed and things can only get worse at this point if the transparency and accountability that Sheriff Gillespie promises so often isn’t actually upheld truthfully and with honest intentions.

As of right now, I have been unable to find any info regarding the specifics of the expected length of the kangaroo court that will begin Thursday or restrictions on public entry into the chambers where it will be held. Although, I suspect this lack of information is intentional, if I do come across that information I will post it here.

This week, Nevada Cop Block will be hosting a special event as part of a local activist get together known as the Las Vegas Anarchist Cafe, which will focus on bringing accountability to Las Vegas area police.

This event, “Disarm the Police,” will be an informational and organizing meeting regarding issues with police brutality, lack of accountability, and official corruption. In addition, there will be discussion about setting up regular actions based around bringing attention to and addressing those issues.

Methods, goals, and acceptable outcomes will all be discussed. Also, information about how to get involved with local police “watchdog” groups, such as Nevada Cop Block (NVCopBlock.org), will be provided for those wanting to become more involved on an ongoing basis.

The Las Vegas Anarchist Cafe meets Saturdays, from 6:00—8:00pm, at Sunrise Coffee Shop, which is located on Sunset Rd. between Pecos and Eastern (map below). The A-Cafe is not a place, it’s an event–a social experiment in urban anarchy, organized by the Southern Nevada Alliance of the Libertarian Left and a group of unaffiliated local anarchists. The A-Cafe is a forum for anarchists in the Las Vegas area to get to know each other, to hang out, to shoot the breeze, to talk some shop, to talk about the projects that we are working on, and to organize new projects. Anyone who’s an anarchist, anti-statist, or just anarchy-curious is invited to join us.

Drop in any time — the gathering is informal, and based on chatting and sharing information. There isn’t a fixed agenda. (But if you want to set up an organizing meeting for a particular project with a fixed agenda, A-Cafe is a great place to meet people to invite.) Feel free to drop in at any time and leave whenever you need to.

So Much Injustice, So Little Pavement.

At the end of today when I got home my hands were black with dirt, my knees were bruised and I have a pretty nice blister going on one of my toes. I did four hours of dancing and then went over to fight for justice for the people who have been murdered by the Las Vegas Metropolitan Police Department. When I say “murdered” I mean just that. I mean that Stanley Gibson, Trevon Cole, Erik Scott and a dozen or so others were actually murdered by the police.

Many of the actions we do against the police are chalking actions because it has the effect of making a powerful statement to people walking by and it lets the police know that we are watching them and won’t stand for this. We know that our corrupt government backs the police 100% of the time and that if a cop kills someone, they’ll get a desk job whereas if I did it I’d face a trial for my life or liberty.

We do not accept this and so once again, we joined others downtown at the Clark County Government Center and the police head quarters up the street to express ourselves and our frustrations on the side walk. I usually know at least some of the people who do this with us. This time I was pleased to find only two people who I’d met before which is good because it means that new people are interested.

One of these people was Rondha Gibson, the widow of Stanley Gibson, she walked around and read the things we wrote and I could see she was very much still grieving a year now since her husband was taken away from her needlessly.

The issue of police brutality is near and dear to the Sunset Activist Collective. Our final point on the eight principles reads that even if a person doesn’t belong to the 1% they can still protect the 1% or long to be among them. That’s what the police do. They make capitalism possible. This idea that the police are here to protect people is bullshit. The police are the internal armed wing of the government, sent to do it and the corporation’s (like Zappos) bidding. We also recognize and oppose a pattern of violence against the poor and against minority groups on the part of the government and the police. For these reasons we stand against the police.

Sunset was instrumental in helping craft the demands against the police department and local government. Sometime ago, the father of victim Erik Scott noticed our demands and helped spread them around. Through these protests we met Rondha and Rondha now knows the Father of Erik Scott. We will bring justice to the people who live here.

The way my hands and knees got scraped up was I spent quite awhile on them scrawling the demands of Sunset and NVCopBlock.org on the sidewalk and then I listed some of the more well known abuses of the police in Vegas, five to be specific: The recent murders of a dog named “Bubba”, Stanley Gibson, Erik Scott, and Trevon Cole, as well as Emmauel Dozier, who didn’t get shot or die but actually shot four pigs who he thought were breaking into his home during an unannounced drug raid. He has been charged with trying to kill these cops. No drugs were found.

I left out quite a few stories of abuse, sexual assault, other murders, and stories of abuse from the North Las Vegas cops or the pigs in Henderson. When I’d finished writing I noticed that these five injustices with our ten demands took up about 25 feet of sidewalk. When you can fill a sidewalk with that much shame and terror then its time for things to stop.

Government has not listened. The public protects the police by enabling them, telling them “thank you” and giving them little things to eat. I say stop. I say adopt the policy of “I don’t speak pig.” You don’t have to tell a cop anything except your name, age and place of residency. You don’t have to show them anything other than your ID. Tonight as we were traveling from the government center to the police Head Quarters a pig pulled up alongside us, got out and said “how’s it going?”

I said nothing. I refuse to let this person into my life or to greet him. He then asked “do you mind if I ask where you are going?” or something like that. Kelly looked at this pig and said “Actually I do mind if you ask, its none of your business.” Then we started walking away. We could hear the cop still trying to talk to people. He reminded me of a nerd that used to linger around everyone when we were hanging out, he’d try and start a conversation with you and you’d just ignore him. It must feel awful to have people give you the cold shoulder. That is how that cop was treated and that makes me happy. That we made this person uncomfortable. I’m proud of Kelly for the correct response. I’m proud of everyone who when asked “who is in charge?” didn’t say anything or said “no one.”

Anyone who talks to the cops legitimizes them. I’m not here to be friendly. I’m here because someone they know murdered someone. I don’t want to hang out and shoot the shit, I’m upset and rightfully so. And anyone who has a problem with me using the word “pig” to describe a police officer, they probably read my web posts and the sunset website. I make sure to call them that so they will read it and have a terrible rest of the day. It’s the least I can do.

As we all were getting packed up we talked about doing this monthly until the revolution comes. We discussed setting up a planning meeting to bring more people down for these. If you’re interested let me know.

For a third time since she was killed almost three months ago, friends, family, and concerned residents will be gathering outside the West Valley, Utah police station to demand answers. This protest is scheduled for January 22nd, which would have been Danielle’s 22nd birthday. Instead it has become a grim reminder of death November 2nd 2012 at the hands of detectives working for the West Valley Police Department, which is located in the Salt Lake City area.

Details from the Facebook event invite:

Please join us on 1/22 at 3:00 pm as we gather together in honor of Danielle Willard and celebrate her birthday she would have been 22. West Valley Police shot and killed Danielle on Nov 2nd while she sat in her car unarmed and still have refused to give any sort of explanation as to why.

In spite of the two previous protests and considerable questions being raised about why a physically small, unarmed young woman was shot, police have been extremely secretive about any of the reasons or justifications behind the case. More information regarding the circumstances surrounding her death can be found in this previous post here on NVCopBlock.org: Why was Danielle Willard Murdered by Utah Police?

From the Original Post by Pete Eyre on CopBlock.org:

Creating primer resources for active groups, ensuring a couple key components are covered, and funding for a month-long mini-tour are the three areas outlined in the video (script below) that I think will be good investments to increase Cop Block’s impact.

Interested and able to help? Please visit: CopBlock.org/Donate

Any coin is much-appreciated, though reoccurring donations will help provide us with a bit more stability so we can budget accordingly.

Setting-up reoccurring donations is easy. When at CopBlock.org/Donate, simply input the amount you want to donate (in this example I used 10FRNs) and click the green “Donate” button.

Then, on the next screen, select the frequency desired (in this example I choose “monthly”).

If you want to help fund one of the specific areas outlined in the video, just click the text “Include a message with your payment” and in the text field box that then appears, type the associated term(s).

In this example I keyed “key components.” If you identify more than one area, your donation will be split equally among them.

All donations received without a comment noting a desired earmark will be used to fulfill the asks given in the video (resources for groups, key components, short tour). If donations above that amount are received, they’ll be used in other ways to advance Cop Block’s mission.

When I get a better idea of the coin raised for the short tour I’ll post my intended route and will work to connect with Copblockers.

Also, keep your eyes open for a new innovative component spearheaded by Ademo Freeman that is sure to draw much attention and involvement – hopefully from yourself:)

Script from Video

If you watch the mainstream news or listen only to those who claim the right to control your life, it’s very likely that you have a pretty bleak outlook on the world today.
But recognize that such a reality – the belief that you yourself, can’t possibly hope to address those problems, as they’re so overwhelming – is the very paradigm being pushed by those attempting to usurp your rights.
Uncertainty and fear are peddled to gain your acquiescence.
Their very existence and the scope of their actions are directly contingent on the authority you grant them.
Fortunately many individuals are thinking for themselves.
They realize that though they’re rightfully disillusioned, there must be a better alternative.
If you’re watching this video, it’s likely you’re already familiar with Cop Block.
If not, I encourage you to check out Cop Block’s About page, but briefly, Cop Block is a decentralized project supported by a diverse group of individuals united by their shared goal of police accountability.
We do not hate cops. We believe that no one – not even those with badges – has extra rights.
We live by that fact and seek to share it with others. Both to safeguard our rights and those of future generations.
We choose to focus on police, because they are quite literally, the teeth, or enforcers of the State.
In fact, police claim a “right” to initiate force.
It is that institutionalized violence that is the issue.
Cop Block was founded three years ago this month.
In that time, the project has grown from a Tumblr site, to a group blog, to its current iteration, as a heavily-trafficked resource.
It’s clear we’re having an impact. But I know we can do more.
That’s the purpose of this video. To help get from here to there.
Over the next few minutes I’m going to share some thoughts and ask for your help, so that we can make more likely a reality where the institutionalized violence we see today is replaced by peaceful coexistence.
My hope is for us to so thoroughly change the conversation about policing, that the need for Cop Block becomes obsolete.
I brainstormed components and tactics we could add or grow, and I incorporated feedback received from Copblockers.
What is certain is that a handful of folks can’t do it all.
Key is decentralization and a consistent message.
I identified three areas that I consider low-hanging fruit, and that I think would offer a good return-on-investment, should you have the interest and ability to help defray costs
Firstly, resources for local groups
We house at CopBlock.org/Groups all known contact info for offshoots as well as allies.
This graphic shows the increased number of local groups, from the fall of 2012, until now.
How did this happened?
We’ve created content, such as the /startagroup document, to help lessen the hurdle for proactive Copblockers, who then plant a flag and connect with those in their area to make a difference on the ground.
We’ve created print-ready flyers to help make it easier to share ideas, made available through our store an inexpensive 200-piece literature pack, and make ourselves available to brainstorm and work together where it makes sense.
Just imagine how different – for the better – things will be when the simple act of making transparent the actions of aggressors becomes the norm.
I’m asking for your help to provide active Copblockers with resources, so that they can do more.
Your reoccurring donation, or one-time donation, earmarked for resources, will be used to have created primer resources, like know your rights documents and videos, and crowdsourceable resources, like print-ready flyers, graphics, a better smartphone app, and to provide literature to active groups.
I hope and think a goal of getting 100FRNs donated per month for resources is obtainable.
And if it the coin is there and it makes sense, one idea is to solicit proposals from groups on how they’d utilize it to have an impact in their area, then put the proposals to a vote on CopBlock.org and allow Copblockers to decide which group to award the coin. Think of it as an X-Prize of sorts for police accountablity.
Secondly, compensation for key components
Cop Block is decentralized. We solicit submissions from those who’ve experienced, witnessed, or have commentary about, police interactions.
There’s not a lack of such content.
Thus far we’ve received over 2,000 submissions.
The editing and scheduling of these submissions has for most of Cop Blocks existence, been done by a volunteer, or a group of volunteers.
But more-recently I started compensating another Copblocker, to the tune of 150FRNs a month, or about five bucks a day, to tackle this integral task.
Ideally, it’d be great if this cost could be covered by folks who appreciate the work, and who have deeper pockets than do I.
In addition to the editor, another vital component I hope to have better-funded is our IT, which is quite literally the backbone of our operations.
Specifically, the hosting that’s provided by Liberty Web Alliance.
Last year CopBlock.org was taken offline by repeated DoS attacks.
A small team of tech-savvy friends hardened the site, and moved it, as well as local cop block offshoots also based on WordPress, to a dedicated server.
That provided much stability.
Yet recent site-related issues have again necessitated the need to step-up our IT, and with that, comes costs, about 200FRNs a month.
So, for these two key components – editing and scheduling submissions, and IT – I’m hoping we can get reoccurring donations earmarked for key components, at 350FRNs per month.
Thirdly, funding for more in-person collaboration
The Internet has undoubtedly been instrumental for the sharing of ideas that now seem so basic
It’s facilitated connections that ignore arbitrary political boundaries and underscore that we’re not alone, which can only empower others to get involved.
And it’s allowed us to bypass completely those who historically have censored the free flow of information.
Yet not to be discounted is in-person communication, which is unparalleled in its qualitative impact.
Prior to focusing on Cop Block, I spent time criss-crossing the states in MARV, the Mobile Authority Resistance Vehicle, with Motorhome Diaries and Liberty on Tour.
Ademo Freeman, who founded Cop Block, was involved in both as well.
When on the road we created hundreds of videos and interacted with thousands of people – including some who’ve since founded Cop Block offshoots.
This past summer I raffled-off MARV and reinvested the coin into my current vehicle – a 1996 turbo diesel Tahoe.
In mid-January I plan to leave the ‘shire and roll to North Carolina to pick-up my motorcycle.
Instead of just rolling down and back, over a couple of days, I plan to, over the course of a month, meet with Copblockers from the eastern seaboard, Midwest and Rust Belt, especially those who have founded groups, so that we can brainstorm, share ideas, hit the streets, and generate content.
This past August when traveling to visit family and friends, I was able to get-together with the founders of Ohio Cop Block and Minnesota Cop Block.
It was clear that our interaction was of much value, to all involved.
I’m hoping you can help defray my fuel costs, to make this short jaunt more realistic.
This one-month jaunt I’m proposing, which will end in late February in Nashua, NH at Liberty Forum, where I’m slated to speak about Cop Block, will be a good way to prove the effectiveness of this outreach tactic on a smaller scale, and make more realistic a future, longer tour, that could incorporate outreach at colleges, know your rights trainings, and Copblocking.
Coin donated and earmarked for “Tour” will be used to help make this possible.
Fuel costs, which I estimate will be about a grand, will be my biggest expense. Any additional monies received will be used to provide resources to Copblockers met.
So to summarize, if you find any of these three areas compelling – groups, key components, or a short tour – and can help make them happen, that’d be much appreciated.
Any other donations made to Cop Block will be used to do outreach to current law enforcement employees, to compensate Copblockers for creating graphics, for video contests, and much more.
CopBlock uses WePay and Bitcoin.
Thanks for your time. And if you’re not able to donate coin, it’s all good – we appreciate link love and even better, learning of your own peaceful, proactive efforts to cause those around you to think.
Remember, decentralizing is key, feel free to implement any ideas you have.
All content or graphics you see generated by Cop Block are free for you to use or modify.
And I’m always down to brainstorm – just shoot me an email at pete@copblock.org

Bubba, Unnecessarily Killed by a Metro Cop

After yet another unnecessary shooting by police of a family pet, something that is beginning to become routine nationwide, Las Vegas residents and “Nevada Voters For Animals,” an animal advocacy group, have organized demonstrations to bring attention to the problem and demand answers from Las Vegas Police.

Bubba, a six year old pit bull was shot Sunday, January 6th by Sgt William Wilson, of LVMPD, while in his own backyard in what many contend was at best an avoidable act and violation of the owner’s Fourth Amendment rights against warrantless searches.

Metro’s version of what happened is that Wilson was investigating a disturbance at another residence (over a block away) when he heard a gunshot. According to Wilson, he also heard “yelling or moaning” coming from the back yard where Bubba was prompting him to enter the gate. This, of course, would negate Fourth Amendment requirements because of the possibility that a badly injured person was in grave danger. During the process of searching for the potential injured person (who has never been found), Bubba ran toward Sgt. Wilson, who felt threatened and responded by shooting him.

Bubba who was killed by Sgt. William Wilson of LVMPD

However, the likelihood of someone being able to pinpoint the exact location of a gunshot from that distance as well as Las Vegas Police’s tendency to lie even when they don’t need to has lead to a lot of second guessing or even outright disbelief regarding the official story. Among those doubters is Allen Lichtenstein, ACLU of Nevada General Counsel:

“Lichtenstein said the police account raises a lot of questions, such as how Wilson knew with certainty which house the gunshot and screaming were coming from while he was a street over. And did police investigate other homes to determine where the yelling or moaning originated?

Lichtenstein said a gunshot heard from a nearby street does not amount to a legitimate circumstance allowing police access to a private backyard without permission.”

The first rally for Bubba, which took place the “Welcome” sign

Other counterarguments about the need to shoot Bubba include, the fact that the owner was home and therefore could have been told to put Bubba in the house, the gate was clearly marked with a “Beware of Dog” sign, and the seeming lack of any sort of investigation or questioning among the owner’s neighbors after the shooting, which would tend to invalidate the claim that they were concerned about someone in the area having been shot.

A previous rally by those skeptical of the circumstances behind the shooting of Bubba was held on Thursday Jan. 10th in front of the “Welcome to Fabulous Las Vegas” sign, which greets tourists at the end of the Strip. The upcoming rally, scheduled for Saturday Jan. 12th, will take place outside the new headquarters of the Las Vegas Metropolitan Police Department, located at 400 South Martin Luther King BLVD.:

“This will be the second protest to demand Justice for Bubba on behalf of Nevada Voters For Animals. The senseless and unjustifiable shootings of animals needs to stop. THE POLICE NEED TO BE HELD ACCOUNTABLE! Bring Loud but tasteful signs. This protest is being held in front of the Las Vegas Metro Police Headquarters.”

Nevada Cop Block strongly encourages anyone that cares about animals and the larger issue of police accountability and the propensity of Las Vegas area police to view gunfire as a first option to attend this and any future rallies.

Tomorrow, Dec. 4th, beginning at 9:30 AM the Clark County Commission is scheduled to vote on proposed reforms to the Coroner’s Inquest process in which killings by Las Vegas area police are reviewed and facts surrounding them are made public.

If you have any desire to see transparency in cases where police shoot people and accountability for those innocent people amongst that rapidly growing number you should do everything you can to attend that meeting and let your feelings be known. (See map below.)

Reportedly, with the exception of Chris Giunchigliani, the commission is preparing to vote against the proposed reforms, which would effectively end the Coroner’s Inquests.

As has been well documented, the original Coroner’s Inquests served more as a dog and pony show where the official cover story was pushed and contradictory evidence and witnesses were minimized or outright withheld. All of which only served to exonerate police when they murdered innocent people rather than as a true fact finding investigation.

The inevitable criticisms and lack of confidence in such an obviously orchestrated and dishonest process led to demands for reforms from the families of people killed by Las Vegas police under suspicious circumstances, several communitty organizations, as well as both the NAACP and ACLU on behalf of victims. The resulting reforms, while not a perfect solution provided for several changes in the Coroner’s Inquest process to bring more transparency and increase the chance for true accountability, such as the ability for the victims to be represented by a lawyer that would have the ability to question witnesses. This in and of itself was an important step forward, since the District Attorney, who controls all the evidence and witnesses presented during the Coroner’s Inquest, has demonstrated a bias toward the police officers involved.

An all too common in the Las Vegas area lately.

Not surprisingly, the police and in particular the Las Vegas Police Protective Association (LVPPA) have very little interest in a transparent process that might expose the murders their colleagues have committed. The LVPPA in it’s misguided attempts to “protect” police regardless of how glaringly wrong individual cops might be in a case or how negatively that affects the ability of other cops to do their job, has advised police not to cooperate with the new inquest should it be implemented. They also attempted to have the reforms thrown out as unconstitutional via a lawsuit that failed, but required that some minor procedural alterations be made to who was in charge of the inquest proceedings.

Unfortunately, largely because of that refusal to participate by local police, the County Commissioners are reportedly ready to buckle to pressure and scrap the Coroner’s Inquest process altogether. This would be bad for many reasons, not the least of which are that the alternatives are dramatically worse than the already inadequate original version of the Coroner’s Inquest was.

In most cases since the Coroner’s Inquests were put on hold, District Attorney Steve Wolfson has been issuing statements to explain his lack of desire to hold officers accountable for their actions. The fact that he recently stated that Henderson police are actually trained to kick defenseless people in the head repeatedly as a reason for not punishing a police officer in one of those statements doesn’t exactly inspire a lot of confidence in that as a viable substitute.

Nor does the use of grand juries as the other apparent option hold much hope for a fair outcome. As was pointed out on this site a while back, grand juries are highly secretive and in pretty much every other respect, including the DA’s exclusive control over witnesses and evidence, have all the same flaws that the previous Coroner’s Inquest process contained.

The lack of accountability for their actions up to and including outright murder has lead to a shoot first mentality amongst the Las Vegas Metropolitan Police Department and other area police. It’s actually getting to the point where it is hard to keep track of the instances of police involved shooting because they happen so often. Recently approved reforms are the only way to ensure transparency and justice for the families of the victims of questionable shooting by local police.

Further Info and Reasons to Support Coroner’s Inquest Reforms:

Erik Scott was murdered by Las Vegas Metro police on July 10, 2010. The obvious problems with the Coroner’s Inquest proceeding in his case were likely the final straw that lead to the current reforms.

Statement (via Facebook post) from Bill Scott, Eric Scott‘s father:

Per Lisa’s appeal (below), please consider being at the County Commissioners’ meeting on 4 Dec.

Potential Outcome 1: If the commissioners cave in to the PPA (police union), only the District Attorney will be deciding whether officer-involved shootings were justified. As DA Steve Wolfson has demonstrated, to date, he NEVER finds fault with Metro shootings, because he relies completely on Metro’s flawed “investigations” of OISs.

In a recent case, Wolfson “chose” to not review high-definition security-system video evidence that clearly proved Metro officers shot and killed a young man for no reason (the Olivas murder). If the DA can’t be bothered to look at indisputable data/evidence that counters Metro’s cover-up narrative, how will 1) victims’ families know the facts surrounding their loved ones’ death, and 2) rogue/bad police officers be held accountable for shooting innocents?

Potential Outcome 2: If the county commissioners decide to eliminate the NEW coroner’s inquest process and go back to the long-ago-discredited grand jury process, reviews of OISs will be a secret, closed-door process. The grand jury would be stacked with “citizens” who are cop-friendly, and, again, rogue/bad cops would be routinely exonerated. That outcome is virtually guaranteed, because appointments to the grand jury would be carefully controlled by those friendly to Metro and beholden to intransigent obstructionists, the PPA union.

If the community is to have any hope of holding its police force accountable, getting rid of dangerous “cowboy cops,” and stopping the epidemic of senseless, deadly OISs, it’s imperative that county commissioners modify the NEW coroner’s inquest ordinance to ensure it complies with the recent Nevada Supreme Court ruling.

That’s a simple change to the existing ordinance, but the PPA union is fighting reinstatement of inquest hearings under the new procedures, and any other credible means for “civilians” to hold police officers accountable for their deadly behavior.

Unless hundreds of Las Vegas-area citizens show up on 4 Dec. and explain to the commissioners that murders-by-cops will NOT be tolerated, the PPA will prevail, and the commissioners will cave to union and DA pressure. And killer-cops will never again be deterred from shooting, when less-than-lethal alternatives would be more appropriate.

As you think about whether to expend the time and effort to attend the 4 Dec. meeting, please consider: If Officer Wm. Mosher had been TRULY held accountable for his 2006 shooting, he might have been either in prison, or fired from the Metro police force and not on the streets of Las Vegas on July 10, 2010. And my son, Erik, would be alive today.

Letting PPA union thugs run roughshod over county commissioners and a community has deadly consequences. Erik paid for Metro/PPA thuggery with his life. Who will be the next killer-cops’ victims?

Thanks for your kind support of this vital campaign to restore justice.

STAND UP FOR YOUR RIGHT TO KNOW.

The Clark County Commission will be discussing the coroner’s inquest process for officer-involved homicides on December 4, 2012 at 9:30 a.m. We need the Commission to pass a simple housekeeping measure to allow the inquests to proceed. The Commission needs to understand that the public does not want it to abandon or water down the coroner’s inquests for officer-involved homicides. The LVMPD has a very high rate of officer-involved homicides, and the public deserves to know the facts when a member of the community is killed.

Meet outside the County Commission building at 9:15 a.m. on December 4, 2012. We will have free t-shirts so you can tell the Commission: “START THE INQUESTS. WE DESERVE TO KNOW.”

What is the inquest process?
In December of 2010, the coroner’s inquest process was reformed into a transparent, public airing of the facts when the LVMPD kills a member of the public. The 2010 reforms did not make the process adversarial. They replaced the jury and verdict with a panel and neutral factual findings. To help get at the truth and ensure fairness, they also provided for participation by the officers, family members, and the public. The reforms were responsive to widespread concerns from citizens and the product of a democratic process and public input. The Sheriff supported the reforms and they also had broad public support (including from PLAN, the Las Vegas NAACP, NACJ, and the ACLU).

Why haven’t we had any inquests since reforms were passed?
Unfortunately, the Police Protective Association (PPA) has fought the implementation of the new inquest process, trying to avoid transparency. The Nevada Supreme Court and the U.S. District Court of Nevada have both rejected the PPA’s arguments that the process violated their rights, finding that the coroner’s inquest is a fair process. The Nevada Legislature also refused to abolish the inquest.

How can we fix the inquests?
The Nevada Supreme Court recently held that justices of the peace cannot preside over the inquests under current law. The Clark County Commission can easily fix this technical, procedural issue if it has the political will to stand up to the PPA. The issue regarding who should oversee inquests was not part of the 2010 changes. The pre-2007 had hearing master, oversee inquests. Just like justices of the peace, hearing masters are attorneys. They already oversee non-officer homicide inquests and are qualified to preside over inquests into officer-involved homicides.

Why should the inquest be fixed?

Stanley L. Gibson, a disabled Army vet, was murdered by Ofc. Jesus Arevalo on Dec. 12, 2012

The public deserves to know what happens when the LVMPD kills a member of the community, and transparency is needed to restore the trust between the LVMPD and the public. The County has spent significant sums of money and time on the 2010 reform process, to defend the inquest in court, and to lobby at the legislature. That money should not go to waste.

Most importantly, since the 2010 changes were passed, there have been 22 officer-involved homicides. This means that a total of twenty two families now stand in line waiting to learn the facts about how their loved ones were killed. Without an inquest, there is no way for families to get direct access to information about their family members’ deaths. The families and the public that employs police officers want and deserve an open and transparent process in place so they can assess the facts surrounding office-involved homicides themselves.

Is there any reason to wait?
There is no reason to keep delaying. While the PPA has appealed the case it lost in federal court to the Ninth Circuit, there is no stay or injunction in place and nothing stopping the inquest from moving forward. In fact, both the Nevada Supreme Court and the U.S. District Court have already determined that the process adequately protects the rights of officers. Even if the PPA continues to improperly refuse to allow officers to participate regardless of whether the officers have any right to the protection of the Fifth Amendment claim, the inquests can move forward. Enough other evidence—evidence such as dispatch records, other witnesses, reports, and even video in some cases—can tell the story of what happened.

No more excuses. Start the inquests. We deserve to know.

————————————————————————————-

Be there and make your voice heard!

In addition, the handling of it all by local police has made many people not just in Utah, but all across the country, question how and why such a small, unarmed woman barely out of her teens with no known history of violent behavior ended up becoming the latest in a growing list of “collateral damage” from the government’s disastrous War on Drugs.

Almost a month ago, on Nov. 2, 2012, Danielle Willard was shot and killed by undercover police working for the West Valley, Utah police department. Apparently, she was killed during an attempted drug bust, although even that is a bit speculative at this point because police have yet to confirm much of anything about what happened that day.

“The family of a 21-year-old woman killed in an officer-involved shooting yesterday await answers in her death. So far, there are still a lot of unanswered questions about the shooting at this apartment complex.

We still don’t know why officers shot and killed Danielle Willard. Her family says, she wasn’t a violent person but drugs may have been her downfall.

Willard’s mother, who lives in Vancouver, Washington, is anxious for information to come out.

“Everything that keeps going through my mind is speculation,” said Melissa Kennedy. “Did she get back on drugs? Was she really clean? Was it the wrong place at the wrong time?”

Willard was shot Friday and killed by undercover officers in the parking lot of an apartment complex in West Valley. Police used white sheets to cover her body from public view. Authorities aren’t saying what led to the shooting.”

Danielle Willard During “Brighter” Days

In fact, police have refused to even comment officially on such basic things as Danielle’s identity or even whether she is male or female. Purportedly, this silence is due to an ongoing investigation into the shooting and the events surrounding it. However, such rudimentary details have not only already been made public by Danielle’s family and friends, but are hardly something that would interfere with an investigation.

Those family and friends are understandably questioning that silence, especially since police normally have no problem releasing information that supports their officers’ version of events. Without any of that information, they are left to try and make sense of why police would need to kill Danielle, which is hard to reconcile with their own memories of her:

“Melissa Kennedy knows her daughter wasn’t perfect.

But she doesn’t understand what it is that her daughter did so wrong that prompted West Valley police to shoot and kill her…

‘…Danielle is a sweetheart. She’s got a big heart. She would give the clothes off her back for anybody. I used to get mad at her because she would use so much gas in our car because someone would want a ride home. She couldn’t tell them no,’ Kennedy said…

‘…She’s never been known to be a violent person. She’s 100 pounds soaking wet. She’s only 21 years old. She’s a tiny little thing. What could she possibly have done, other than having a gun, what could she have done to provoke them to shoot her?…I’ve never ever known her to keep a gun with her or anywhere around here,’ Kennedy said…

‘…Kayleen (Willard) said she admired her older sister.’I always wanted to be like her. She always inspired me, because she was always so happy. She always seemed to be the crowd pleaser. She always seemed to brighten up a room,’ Willard said. ‘She was an inspiration to me, she made me be the person I am today. She made me want to be a better person growing up. She will always be in my thoughts and my heart, and she’s in a better place right now and I’ll see her again some day.’”

In spite of the silent treatment from West Valley police, some details about that day have gotten out. As might be expected, those details don’t paint the undercover cops that killed Danielle in a very good light. Based on independent witnesses that have come forward and the limited admissions that detectives assigned to the case have made themselves several things have been established:

Danielle was not armed, nor were there any guns found within the vehicle where she was killed. (As confirmed by detectives)

Danielle was actually a passenger in her own vehicle and was attempting to seek cover by ducking down within the car at the time of the shooting.

It’s unlikely that Danielle was the target of the ill-fated drug bust. Whether she was in some way involved with drugs again or simply in the wrong place at the wrong time is unknown. However, even if she was that by itself would in no way justify her death.

An unidentified male, who fled the scene and was probably the one being targeted by the undercover cops, was driving the car. (Detectives Danielle’s mother spoke to actually denied that this person was present, which only raises more questions about why deadly force was necessary.)

According to the autopsy, Danielle was shot first in the cheek and then fatally in the top of her skull, which supports the witness accounts that she was ducking down at the time she was shot.

The every day abuses and unintended negative consequences of the War on Drugs, as well as the selective nature of that war, should be enough to cause outrage at the unnecessary death of yet another person whose only real “crime” was an act which by itself only harms the person committing that act. No matter what your stance on drug use and its effect on those who become addicted, it should be apparent that the harm caused by drug prohibitions far outweigh any positive effects of such policies.

The bottom line is Danielle Willard should never have been killed in the first place and those who care about her deserve answers for why she was murdered in spite of being unarmed and, by all accounts, not acting in any aggressive manner at all. Unfortunately, police are in no hurry to provide those answers.

There are several ways that you can help seek justice for Danielle:

If you are in or have the ability to travel to West Valley, Ut., join those who will be there at the rallies to support them as they demand that justice in person. Other options to contribute from a distance include donating funds to offset funeral costs and the costs of traveling from Washington, where her family lives, to Utah. This is the link to do that via an online fundraiser. Yet another option is to call the West Valley Police Department at (801) 963-3300 or (801) 965-5155 and let them know that you want justice for Danielle.

Based on his and other local officials’ history of covering up and minimizing police crimes, we feel that nothing short of that will be required in order to bring accountability to the Las Vegas Metropolitan Police Department.

Here are those demands in their entirety:

1. We believe that the grand jury is a worse, more corrupt process when applied to public officials than the old Coronor's Inquest was and is only used when other public officials want to cover up their crimes while appearing to actually hold them accountable. Therefore, we demand that District Attorney Steve Wolfson file charges directly for a public jury trial against Officer Jesus Arevalo for the murder of Stanley Gibson.

2. We demand a face to face televised apology by Sheriff Doug Gillespie to the families of Stanley Gibson, Trevon Cole and Erik Scott.

3. We demand the immediate resignation of Sheriff Doug Gillespie at the conclusion of demand #2.

4. We demand that any seized property be returned to the victims of police shootings. If that property has already been disposed of, then a equitable and fair compensation should be arranged within a reasonable amount of time.

5. We demand compensation for the victims of police shootings, including but not limited to monetary compensation, all lost future wages, funeral expenses, property damages, medical expenses and one half the expense of a four year college education for each child of the victim.

6. We demand that all charges against Emmanuel Dozier be dropped on the basis of the right to self defense.

7. We demand an end to the tactic of neighborhood saturation, which really amounts to targeted and unlawful harassment primarily of low income and minority neighborhoods. A majority of residents whose only crime is being poor shouldn't have to be harassed because a small minority of their neighbors have committed crimes (many of which fall into the category of victimless drug crimes).

8. We demand that any police officer who engages in a shooting that wounds or kills a person who is unarmed be placed on unpaid leave pending a public trial. Nobody else gets an automatic paid vacation for shooting someone.

9. We demand that police prominently display their badge numbers and not interfere with public observation, including being filmed, by anyone while on duty. Citizens already have a legal right to record public official performing their jobs in public spaces and transparency serves the dual functions of deterring abuse of authority and providing a neutral witness of any interactions.

10. We demand that if local or state government enacts unjust laws such as a law similar to Arizona's SB1070 or a ban on feeding the homeless, that the police department refuse to enforce such laws. "I'm just doing my job" has never been a good excuse for participating in acts of injustice.
