Bodycam Video: Nevada Deputy Unnecessarily Shoots Pet Dog; Jokes “Maybe I’ll Get Time Off Now!”

Nye County Nevada Pahrump Dog ShootingOn April 10th, Deputy John Tolle of the Nye County Sheriff’s Office responded to what turned out to be a false panic alarm at a residence in Pahrump, NV. (Located just Northwest of Las Vegas.) Soon after Deputy Tolle entered the fenced in yard of that residence and knocked on the door, he shot the pet dog of the owner. According to Tolle, that dog, a pit bull named Blu, was barking, growling, and attacking him at the time. So, obviously he had no choice but to shoot it.

However, Deputy Tolle was wearing a body camera at the time and the footage from that camera tells a completely different story. While the dog does come running from the back of the house much like any dog would when a stranger enters its yard, it never appears to attack Tolle or even try to on the video. Rather than charging toward him “full on, growling and snarling,” as he described, the dog’s action would more properly be described as a quick jog without any sort of aggression being shown at all.

In addition to the discrepancies in Tolle’s description of the shooting of the dog, the body camera footage also highlights numerous issues with the way he responded to the call from the start. Had Deputy Tolle followed proper procedure regarding those issues, he would have never been in a position to shoot Blu in the first place. Among other things, Tolle never tried to contact the owner, Gary Miller, prior to entering the gate of the fence surrounding the yard. Nor does he check first to find out if there is a dog within that yard. Both of those precautions would have prevented any perceived confrontation with Blu from happening.

Furthermore, once the dog was approaching Deputy Tolle he never attempted to use any non lethal deterrents prior to shooting it. As of 2015, state mandated (NRS 289.595) law enforcement training is required to include a course on how to handle situations involving encounters with dogs. Part of that training is that non-lethal methods, such as tasers, batons, or mace, be used prior to resorting to deadly force. Tolle had every one of those options available at the time and never even attempted to use them. There was even enough time after the dog had initially barked for Tolle to simply walk back out of the gate, had he chose to do so. Instead, he just shot the dog and then lied about it attacking him to try and justify having done so.

This video is also pretty telling in relation to the mindset and attitudes of the officers involved. Beyond the simple act of unnecessarily killing the dog and then lying to rationalize it, Deputy Tolle’s body camera also caught a few other things afterwards. First, as an unnamed detective and Tolle’s supervisor, Sergeant Deutsch, discuss the shooting with him, they can be heard making disparaging remarks about Miller and joking about him being angry because his dog was shot.

Deputy Tolle really takes the cake when he is informed that he will have to fill out a “use of force” form for the incident. His response is to break out in laughter and state, “Maybe I’ll get time off now!” It’s almost like getting a free paid vacation is in the forefront of police officers’ minds when they kill.

In the end, the Nye County Sheriff’s Office quickly cleared Deputy Tolle after assigning him to take a 24 hour training course (that presumably teaches cops not to murder non-threatening dogs). Meanwhile, Gary Miller was disrespected even more when the animal shelter cremated his beloved pet without even notifying him first. They then added insult to injury later when they brought him ashes that they claimed were Blu’s, but that were in fact not from his dog. (It’s not clear where the “fake ashes” actually came from. However, unlike Tolle, the animal control officer responsible has been suspended, as a result.)

Know Your Rights Seminar Held in Las Vegas by Attorney Stephen Stubbs (Video)

Note – this is an update of a previous post: “Las Vegas Know Your Rights Seminar by Attorney Stephen Stubbs to be Held March 23rd.” This post includes a video of that know your rights seminar.

On March 23rd in Las Vegas, local attorney Stephen Stubbs held a “know your rights” seminar. Although this know your rights class was open (and very much relevant) to the general public, the primary reason for it being held was recent harassment of motorcycle riders in Las Vegas by the LVMPD (“Metro”) using saturation teams and the gang task force, including a “motorcycle intelligence unit” specifically created to gather information on motorcycle clubs.

As Stubbs mentions in the Facebook Live video embedded below, this harassment has involved the profiling of people that ride motorcycles and several violations of those people’s rights. That includes manufacturing suspicion to stop them, attempting to force passengers to ID themselves, and detaining them longer than is required to perform an investigation related to the (often dubious) offense that they have been stopped for.

Obviously, the motivation behind these targeted stops and the attempts to question those stopped is to gather information about motorcycle clubs under the false pretense that anybody belonging to a motorcycle club is a criminal and the even more flawed pretense that anyone riding a motorcycle and/or fitting a certain description must belong to a motorcycle club. Beyond that, Metro has also been known in recent years to illegally put pressure on public businesses, such as bars, to attempt to force them to exclude members of bike clubs from those businesses. This often is done under the threat of having their liquor license taken away.

Included below are embedded videos containing the entire know your rights seminar, as well as a shorter excerpt discussing a somewhat controversial method of handling general police encounters in which police insist on questioning you even after you’ve already invoked your Fifth Amendment right not to speak (use at your own risk).

As regular readers of the CopBlock Network know, Stephen Stubbs has a pretty long history (see “related posts” section below) of defending the civil rights of people (including himself) against the police, especially those departments located within the Las Vegas area. That has included defending motorcyclists against the frequent harassment they receive from the LVMPD.

Stubbs has also in the past done know your rights seminars numerous times at events and for various groups (as well as independently) throughout the Las Vegas area. (See below for an embedded video of a previous know your rights training.) Among other things, these seminars typically will cover issues involving the First, Fourth, and Fifth Amendments such as the requirements for a legal detainment, when you are obligated to identify yourself to police, your rights when the police want to search you, your right to remain silent and why that’s a good idea, and your rights when filming the police (and why that’s also always a good idea).

In spite of the direct motivation for this particular know your rights seminar being the harassment directed at motorcyclists, the topics and rights discussed were not exclusive to cyclists and are helpful and applicable to anyone that is stopped by the police.

The LVMPD Gang Task Force is Corrupt and it Extends All the Way to the Top

LVMPD Gang Task Force Corruption Stephen Stubbs

Las Vegas lawyer Stephen Stubbs discusses corruption within the LVMPD Gang Task Force, why it goes all the way to the top, and their retaliation attempts.

The video above was made by Stephen Stubbs, a Las Vegas attorney. Stubbs has been featured many times on Nevada Cop Block (see the first “Related Posts” section below) both for issues involving clients he is representing, as well as several times when he himself has been the target of the LVMPD or other Las Vegas area police departments.

In this video, he discusses corruption within the Las Vegas Metropolitan Police Department’s Gang Task Force and shows how it isn’t just the proverbial “Few Bad Apples” involved, but rather how it extends all the way up to the top of the leadership of the Task Force and Metro itself.

He discusses the case where he first was the subject of a CopBlock post, in which he was illegally arrested by (now) Lt. Yesenia Yatomi after he refused an unconstitutional order to leave while they questioned one of his clients. He also discusses other instances in which he has personally been targeted by the LVMPD, including one where they tried to ruin his reputation and possibly even put him in a position to be harmed physically by starting a rumor that he was a confidential informant.

Personally, I think the corruption is far from limited to the Gang Task Force or even the LVMPD. Las Vegas area police are incredibly corrupt from top to bottom. And just in case you need a refresher on that corruption I’ve included a section below that links to every post on CopBlock.org that involves the LVMPD and/or other Las Vegas area police departments.

While I didn’t go through and do an official, scientific count (because I have to sleep sometime), I have very little doubt that the 150+ posts included in the two “Related Posts” sections below represent the largest number (by far) of posts involving any single metropolitan area in the country on Cop Block. So, if you have a few free days or a holiday weekend coming up, scroll through there sometime and see just how many times Las Vegas area police have been caught red handed in their corruption and abuse.

Nevada Police Have Received $11.8M Worth of Military Gear

Nobody really saw much of a difference.

After the heavy-handed and overzealous response to protesters by Ferguson police put the militarization of police in a national spotlight, it is becoming increasingly apparent just how much of a dotted line the boundary between the police and military has become over the past few years.

As Las Vegas’ CBS affiliate reports, Nevada police departments have been doing their share of feeding at the trough of leftovers generated by Washington’s perpetual wars over the past 20+ years:

“RENO, Nev. (AP) — Law enforcement agencies in Nevada have accumulated $11.8 million worth of military gear from the Pentagon through a surplus program under increasing scrutiny since the police response to protests over the killing of an unarmed Missouri teenager.

Defense Department records show over the past 17 years Nevada officers have received about 300 semi-automatic rifles, a half dozen mine-resistant and armored vehicles, three helicopters and a pair of grenade launchers.

Tod Story, head of the American Civil Liberties Union in Nevada , says the militarization of local police sends the wrong signal to communities where officers are supposed to protect residents, “not assault them.”

Washoe County sheriff’s spokesman Bob Harmon says the Huey helicopter worth nearly $1 million they obtained in 1997 has helped save many lives during rescue and firefighting missions.”

Wrongfull Arrest of Pregnant Woman in Pahrump Nevada

This post was received via submission from Genevieve Sazlov, who is (or was at the time of the incident described) a resident of Pahrump, a city just north of Las Vegas. She alleges that while she was pregnant members of the Pahrump police arrested her, based on claims made against her by the father of her unborn child. She further states that her own health issues at the time of the incident should have made it obvious that those claims were false. Apparent proof of that would be the fact that she was released by a supervisor at the jail without any chargers being filed.

I was 5 months pregnant calling 911 for an ambulance because I had a nose bleed that went on for 6 hours the night before. The father who was on drugs at the time woke me up in the morning and told me I had to get out. Mind you he just uprooted me from a small town in Texas five days earlier with all my stuff including my animals.

He wakes me up telling me to get out I sit up from the bed and my nose starts bleeding again so I ask him to take me to the hospital, but he refuses. So, I call 911 for an ambulance. The 911 operator asks me several times if it’s a domestic dispute. I say, “NO, I need an ambulance.”

Well guess who shows up first? The fucking cops. I go outside and say, “I didn’t call the cops. I need an ambulance.” They said, “it’s coming.” Then here comes the ambulance. They are in the middle of helping me pack my nose when one cop starts asking to go thru my purse. I say yes, confused.

Then I’m surrounded by cops asking me when the last time I did cocaine. I’m fucking confused now, but not too much. Baby daddy is lying to them so I will get kicked out. They finally get a female officer to take pee from me. Again, nothing in my system. Then they say, “he says you kicked him and he’s got a mark.” I said, “no, I didn’t kick him. How could I kick him when I’m choking on blood.” They fucking arrested me!!!

I get to the jail and my nose starts bleeding again, this time I am throwing up blood. The main guy of the jail comes in and says, “Genevieve, today we didn’t arrest you. Today we are not arresting you.” The douche bag rookie who did arrest me argues with him, but the elder precedes and I’m released in an ambulance back to the hospital. I fucking hate the police state.
