Know Your Rights Seminar Held in Las Vegas by Attorney Stephen Stubbs (Video)

Note – this is an update of a previous post: “Las Vegas Know Your Rights Seminar by Attorney Stephen Stubbs to be Held March 23rd.” This post includes a video of that know your rights seminar.

On March 23rd in Las Vegas, local attorney Stephen Stubbs held a “know your rights” seminar. Although this know your rights class was open (and very much relevant) to the general public, the primary reason for it being held was recent harassment of motorcycle riders in Las Vegas by the LVMPD (“Metro”) using saturation teams and the gang task force, including a “motorcycle intelligence unit” specifically created to gather information on motorcycle clubs.

As Stubbs mentions in the Facebook Live video embedded below, this harassment has involved the profiling of people that ride motorcycles and several violations of those people’s rights. That includes manufacturing suspicion to stop them, attempting to force passengers to ID themselves, and detaining them longer than is required to perform an investigation related to the (often dubious) offense that they have been stopped for.

Obviously, the motivation behind these targeted stops and the attempts to question those stopped is to gather information about motorcycle clubs under the false pretense that anybody belonging to a motorcycle club is a criminal and the even more flawed pretense that anyone riding a motorcycle and/or fitting a certain description must belong to a motorcycle club. Beyond that, Metro has also been known in recent years to illegally put pressure on public businesses, such as bars, to attempt to force them to exclude members of bike clubs from those businesses. This often is done under the threat of having their liquor license taken away.

Included below are embedded videos containing the entire know your rights seminar, as well as a shorter excerpt discussing a somewhat controversial method of handling general police encounters in which police insist on questioning you even after you’ve already invoked your Fifth Amendment right not to speak (use at your own risk).

As regular readers of the CopBlock Network know, Stephen Stubbs has a pretty long history (see “related posts” section below) of defending the civil rights of people (including himself) against the police, especially those departments located within the Las Vegas area. That has included defending motorcyclists against the frequent harassment they receive from the LVMPD.

Stubbs has also in the past done know your rights seminars numerous times at events and for various groups (as well as independently) throughout the Las Vegas area. (See below for an embedded video of a previous know your rights training.) Among other things, these seminars typically will cover issues involving the First, Fourth, and Fifth Amendments such as the requirements for a legal detainment, when you are obligated to identify yourself to police, your rights when the police want to search you, your right to remain silent and why that’s a good idea, and your rights when filming the police (and why that’s also always a good idea).

In spite of the direct motivation for this particular know your rights seminar being the harassment directed at motorcyclists, the topics and rights discussed were not exclusive to cyclists and are helpful and applicable to anyone that is stopped by the police.

LVMPD Gang Task Force Corruption Stephen Stubbs

Las Vegas lawyer Stephen Stubbs discusses corruption within the LVMPD Gang Task Force, why it goes all the way to the top, and their retaliation attempts.

The video above was made by Stephen Stubbs, a Las Vegas attorney. Stubbs has been featured many times on Nevada Cop Block (see the first “Related Posts” section below) both for issues involving clients he is representing, as well as several times when he himself has been the target of the LVMPD or other Las Vegas area police departments.

In this video, he discusses corruption within the Las Vegas Metropolitan Police Department’s Gang Task Force and shows how it isn’t just the proverbial “Few Bad Apples” involved, but rather how it extends all the way up to the top of the leadership of the Task Force and Metro itself.

He discusses the case where he first was the subject of a CopBlock post, in which he was illegally arrested by (now) Lt. Yesenia Yatomi after he refused an unconstitutional order to leave while they questioned one of his clients. He also discusses other instances in which he has personally been targeted by the LVMPD, including one where they tried to ruin his reputation and possibly even put him in a position to be harmed physically by starting a rumor that he was a confidential informant.

Personally, I think the corruption is far from limited to the Gang Task Force or even the LVMPD. Las Vegas area police are incredibly corrupt from top to bottom. And just in case you need a refresher on that corruption I’ve included a section below that links to every post on CopBlock.org that involves the LVMPD and/or other Las Vegas area police departments.

While I didn’t go through and do an official, scientific count (because I have to sleep sometime), I have very little doubt that the 150+ posts included in the two “Related Posts” sections below represent the largest number (by far) of posts involving any single metropolitan area in the country on Cop Block. So, if you have a few free days or a holiday weekend coming up, scroll through there sometime and see just how many times Las Vegas area police have been caught red handed in their corruption and abuse.

Nevada Court Upholds Firing of North Las Vegas Cop for Covering Up Brother’s Crime

On June 25th, the Nevada Supreme Court overturned a decision by a lower court that would have reinstated a North Las Vegas police officer. That officer, Lazario Ruiz, was fired after he failed to report and then lied about an incident in which his brother argued with and then stole jewelry from another man. Officer Ruiz was present during the confrontation, which involved a brother-in-law, but also made no effort to intervene or prevent the crime.

Police are legally required to report any crimes they witness. Police department policies also generally require officers to stop and/or apprehend anyone they see committing a crime. There are some “discretionary” exceptions, but that would hardly be appropriate when a family member is involved in something that is clearly a criminal act. (There is quite obviously a victim here.)

According to the Las Vegas Sun:

The court overturned the decision of District Judge Valorie Vega who had ruled the procedure was faulty in dismissing Ruiz for untruthfulness and unprofessional conduct.

North Las Vegas Police BadgeRuiz was present when his brother Tony confronted Oscar Talamantes, a brother-in-law, over money in August 2009. After the argument, Tony Ruiz ripped two gold chains off the neck of Talamantes and fled. Talamantes reported a robbery to police.

North Las Vegas officials maintained that Officer Ruiz was within 2 feet of the incident, never made a police report or made any effort to stop his brother. He maintained he did not see the encounter.

During the investigation, Ruiz gave four statements that the city said were untruthful.

An arbitrator admitted the four statements in his review of the case and ruled the dismissal was proper.

Judge Vega held that the four statements of Ruiz violated the Police Officer’s Bill of Rights and ruled in favor of the officer to return to his job.

The court ruled that there was substantial evidence to back the decision of the arbitrator and taht (sic) Judge Vega abused her discretion in ruling in favor of Ruiz.

So, Judge Vega’s ruling aside, that’s a rare bit of accountability for the Las Vegas area police departments. To be fair, even the LVMPD has somewhat of a track record of firing cops involved in financial crimes. It’s just that killing people thing they don’t seem to be too concerned about.

I went through three DUI checkpoints on the night of this incident, and this is the only one that did not release me immediately upon refusing to answer questions.

I was detained at a DUI checkpoint for refusing to answer their questions, after refusing to answer all questions I was released after nearly six minutes.

Hey, my name is Bridger Kennedy. I was just in jail for a DUI (my own prescription medication) that I had taken four-hours prior to driving and while I was in the Clark County Detention Center in Las Vegas, Nevada I was beat up pretty bad in there by about six correction officers.

Prior to my intake picture my face was pushed up against the wall and my bare feet were stepped on with their boots, then after the picture was taken – both front and sideways being jerked around like a rag doll – fingernails gripped into the inner part of my biceps leaving bruises.

I was then put in this black restraint chair and my hands were handcuffed til the very last notch on the cuff. I was shoved to sit down, my balls kneed on by one of the officers, my ankles were cuffed as tight as possible too, and then put some type of thigh winch strap thing around both my legs – smashing my knees together.

I then was taken out and seated in the big intake room (left side guys, right side girls). I was seated in the last row 2nd or 3rd seat to the left, everything was going fine. About 30-minutes had passed by when I had seen people asking to register on the phone so that they could make calls to people outside of the jail on one of the two phones available to do so.

There was one man on the left phone registering and there wasn’t anyone on the right phone, so I asked this African American female correctional officer (CO) if I can please register? She rudely answered with a snotty ‘No’ and turned away from me, at that point I didn’t say anything. About one-minute later a female inmate asks her if she could register and the CO gladly says ‘Yes’ to her, so at this point I said that is messed up why can’t I register and she can? Then this Hispanic CO says “Stand up motherfucker get over here” so I stood up and by the time I was on my feet he was rushing me and grabbed my wrist then threw me to the side.

By this point two other officers were running up and helped him throw me face down onto the ground and kneeing me in the back of the head.

I just had surgery to get my portacath removed two days prior to being in the jail. I have been in remission from cancer for three years now I was diagnosed with non Hodgkin’s lymphoma when I was 17 (I will be 21 on December 28 of this year). I was face down yelling to them I had cancer and just had surgery.

The CO’s came over and piled their weight on top of my chest head arms legs back and feet while I can barely breathe I was yelling I have asthma as well since I was a little kid and now they are yelling to me to stop resisting when I wasn’t resisting whatsoever.

I couldn’t move and inch of any part of my body, at this point I am in excruciating pain and am being lifted up by my wrists and being taken back the the black restraint chair again. I was then once again strapped into the chair as tight as they possibly could after about 45-minutes in the chair. I just couldn’t bare the lack of circulation to my hands and feet. My upper thighs had lost the feeling in them by now, so I power through another hour and about 25-minutes of the chair each time having a spit mask on when I never spit or attempted to once.

They took me out and went and sat back down once again in the same chair I originally was in the first time I sat.
